Welcome to Peachtree POCUS, LLC ("Peachtree POCUS"). By accessing or using this website, courses, consulting, or QA services, you agree to the following Terms & Conditions ("Terms").
1. Acceptance of Terms
By using this website or engaging Peachtree POCUS services, you agree to these Terms. If you do not agree, you may not use the site or services.
2. Services
Peachtree POCUS provides educational content, courses, consulting, and QA services. All services are educational in nature and subject to the disclaimers set forth in Sections 12 and 13 below.
3. Intellectual Property
All course materials, consulting resources, and website content are owned by Peachtree POCUS. You may not copy, distribute, or modify materials without written consent.

You agree to indemnify, defend, and hold harmless Peachtree POCUS, its officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from your misuse of materials or services, violation of these Terms, or failure to comply with applicable laws.

Peachtree POCUS reserves the right to suspend or terminate access to services or materials at its discretion, including for nonpayment or misuse. Where practical, Peachtree POCUS will provide reasonable notice before termination, except in cases of serious misuse.

Peachtree POCUS is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, or technology outages.
10. Updates to These Terms
Peachtree POCUS may update these Terms at any time. For material changes, Peachtree POCUS will make reasonable efforts to provide notice, such as by email or a notice on this page. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
11. Course Disclaimers
These disclaimers apply to all Peachtree POCUS courses and educational programs, including but not limited to the POCUS Kickstart course and any other courses offered by Peachtree POCUS.
11a) Proficiency Disclaimer
Participation in a Peachtree POCUS course alone is not sufficient to achieve clinical proficiency in ultrasound. Proficiency requires continued practice, mentorship, and adherence to quality assurance protocols. Medicine is an ever-changing field. Standard safety precautions must be followed, but as new research and clinical experience broaden the knowledge base, changes in treatment, techniques, and imaging practices become necessary and important. Participants are advised to check the latest product information provided by the manufacturer of each imaging system to verify current recommendations for use.
11b) Liability Disclaimer
Peachtree POCUS is not responsible for any clinical decisions, diagnostic errors, or patient care issues arising from the use of ultrasound. It is the responsibility of the participant to adhere to clinical guidelines, seek proper credentialing, and ensure competency through ongoing training and supervision. Information within these activities is not provided as medical advice, does not establish a doctor-patient or other relationship, and is not intended nor should it be assumed to guarantee a specific result. Participants assume full responsibility for any use of the information contained in these materials and any claims, loss, or damages that may result.
12. POCUS Review Service
The Peachtree POCUS Review Service is provided for educational, quality assurance, and credentialing support purposes. It is not a clinical consultation, a second opinion, or an interpretation of any imaging study performed for use in patient care.
This service is not an overread. An overread is an independent clinical interpretation of a diagnostic imaging examination intended to guide patient management. The POCUS Review Service does not function as an overread and should not be treated as one. Feedback is retrospective in nature and is not designed or suitable for real-time clinical decision-making, regardless of how it is used for quality assurance or credentialing purposes.
Clinical responsibility remains with the treating clinician. The clinician who performed the POCUS examination is solely responsible for interpreting the findings, integrating those findings with the clinical presentation, and determining the appropriate course of care. No feedback, comment, or suggestion provided through this service alters that responsibility. The treating clinician's judgment governs patient care, not this service.
This service does not create a physician-patient relationship. Use of the Peachtree POCUS Review Service does not establish a physician-patient or provider-patient relationship between Peachtree POCUS, Joshua Guttman, MD, any affiliated reviewer, or any other person associated with this service and any patient whose examination is submitted for review.
Do not apply feedback from this service to active patient care. Reviews are completed after the clinical encounter. They are not intended to modify, confirm, or supersede the treating clinician's original interpretation, and they should not be used to alter the management of any patient.
Patient privacy. All patient information must be de-identified before submission. Submission of protected health information (PHI) through this service is not permitted. You are responsible for ensuring that all materials are properly de-identified and for complying with all applicable privacy laws, including HIPAA and any applicable state regulations, before submitting any materials.
Multiple reviewers. Reviews may be conducted by Joshua Guttman, MD or by other qualified reviewers affiliated with Peachtree POCUS. All reviewers operate under the same scope and limitations described in this section.
By submitting materials for review, you confirm that you have read and understood this section, that you have complied with all applicable privacy requirements, and that you will not apply feedback from this service to clinical care.
13. Confidentiality of Submitted Materials
Materials submitted through the POCUS Review Service are treated as confidential. Peachtree POCUS will not share submitted materials with third parties without the submitter's consent, except as required by law. De-identified submissions may be used internally for quality assurance purposes.
